Kenya Airways Plc, East Africa’s largest carrier, is facing a lawsuit exceeding $1 million in the United States, adding pressure as the airline grapples with mounting losses, negative equity, and an urgent need for fresh capital.

The case was filed on June 2, 2026, by Aero Industrial Supply Co. Inc., a New York-based aviation parts distributor, in the U.S. District Court for the Eastern District of New York, alleging breach of contract over supplied aircraft components.

Mounting financial strain for Kenya Airways amid supplier concerns
Court filings show summons were served on June 10, with Kenya Airways expected to respond by July 1. While relatively small compared to the airline’s total liabilities, the dispute underscores broader concerns about liquidity constraints and supplier relationships.

The airline reported cash and cash equivalents of Ksh5.33 billion ($41.1 million) at the end of 2025, against total borrowings of approximately Ksh145 billion ($1.12 billion) and lease liabilities of Ksh48.73 billion ($375.77 million).

Accumulated losses stood at Ksh206.88 billion ($1.6 billion), with total liabilities exceeding total assets by Ksh132.07 billion ($1.02 billion), reflecting deep balance-sheet stress. Net current liabilities were reported at Ksh91.5 billion ($705.65 million), highlighting significant short-term obligations.

Kenya Airways return to losses after a brief recovery
The lawsuit follows a difficult financial year in which Kenya Airways posted a net loss of Ksh17.16 billion ($132.34 million) for the year ended Dec. 31, 2025, reversing a profit recorded in 2024.

Revenue declined 14.3% to Ksh161.47 billion ($1.25 billion), while the airline swung to an operating loss of Ksh5.61 billion ($43.26 million) from an operating profit of Ksh16.62 billion ($128.14 million) a year earlier.

Passenger traffic dropped 13%, with cargo volumes falling 8%, reflecting weaker demand and operational disruptions.

Fleet challenges weigh on Kenya Airways’ operations
Performance was further impacted by fleet disruptions linked to extended maintenance requirements on Boeing 787 Dreamliner engines, which reduced capacity across key international routes.

Several aircraft remained grounded for prolonged periods due to global supply-chain constraints affecting engine overhauls, disrupting services to major destinations including New York, London, Amsterdam, and Paris. Available seat capacity declined between 15% and 18% during parts of the year, forcing schedule adjustments and limiting the airline’s ability to capitalize on recovering international travel demand.

Government support remains critical for Kenya Airways
The Government of Kenya, which holds a 48.9% stake, remains the airline’s largest shareholder and creditor. Kenya Airways disclosed shareholder loans of Ksh131.49 billion ($1.01 billion) from the state, with interest payments deferred for a fourth consecutive year in 2025.

The airline said continued government backing is central to its ability to operate while pursuing a long-term recapitalization plan, with auditors noting that its going-concern status depends on sustained support. Management is pursuing a strategic capital raise estimated at approximately Ksh194 billion ($1.5 billion), aimed at strengthening the balance sheet, reducing debt, and supporting fleet expansion. The airline has indicated that an international investor tender could be launched as part of the process, with completion targeted by early 2027.

Options under consideration include debt restructuring and potential conversion of government loans into equity, forming a core part of Kenya Airways’ turnaround strategy. The outcome of the capital raise will be critical in determining whether the airline can stabilize operations, reduce reliance on state support, and return to sustained profitability while maintaining its role as a key connector between Africa and global markets.
